What is Bankruptcy?

Bankruptcy allows people with large unmanageable debts to find some relief. At the same time creditors are also treated fairly during the bankruptcy process.
There are two types of bankruptcy: Chapter 7 and Chapter 13:
- Chapter 13 bankruptcy
Allows the debt owed to be paid back in a three to five year repayment plan. One keeps all their property but has to pay a certain monetary amount to the trustee. This is usually done by individuals with a steady wage or income. - Chapter 7 bankruptcy
The debt that is owed can be reduced by agreeing that the trustee can take personal property and sell it to pay off the debt. There are some property that is exempt from being sold, or liquidated, in this way. State laws dictate how much they can take.
